OSS terms of use

The TransBIB One-Stop-Shop (OSS) is a beta version. Use of the beta version is at the user’s own risk. We assume no liability for the uninterrupted availability of the service or the accuracy of the information generated by information sources or AI tools.

The project’s liability for damages resulting from the use of the TransBIB One-Stop-Shop is limited to intent and gross negligence. In the event of slight negligence, we shall only be liable in the event of injury to life, limb or health or in the event of a breach of a material contractual obligation (cardinal obligation).

All rights to the personal data entered by you remain with you. You grant the TransBIB project a free, non-exclusive and transferable right of use to the content you provide (such as offers, requests, chat entries), insofar as this is necessary for the provision, operation and further development of the one-stop shop. This right of use of personal data is limited to the duration of the project.
For the period after the end of the project, you grant the project an unlimited right to use the content you have provided in anonymised form for scientific, archival and statistical purposes. For this purpose, the project will ensure that all direct and indirect references to persons are removed from the content after the end of the project period. Any further use requires your written consent.

Scraping or copying data from the OSS by other users or third parties is strictly prohibited and will be prosecuted.

The user undertakes not to use the service for illegal purposes. He/she is solely responsible for the content he/she posts and assures that it does not violate applicable law or the rights of third parties (e.g. copyrights, personal rights). In particular, the posting of offensive, extremist or otherwise illegal content is prohibited.
The TransBIB project reserves the right to temporarily or permanently exclude users from using the service without prior notice in the event of a breach of these terms of use or other abusive behaviour.

The project reserves the right to amend these terms of use. Users will be informed of significant changes appropriately, for example through a notice on the website. Continued use of the service after notification of a change shall be deemed to constitute acceptance of the new terms of use.
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law or a special fund under public law, Munich is agreed as the exclusive place of jurisdiction for all disputes arising from this contractual relationship. Should individual provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions.
